These Terms extend their jurisdiction over and regulate the utilization or entry into the website www.dsquarepro.in and its corresponding mobile/web applications, collectively referred to as the "Platform." As a user ("you," "your," or "User"), these Terms shall be binding and applicable concerning the specific Services you engage with on the Platform.
These Terms, recognized as an electronic record under the (Indian) Information Technology Act, 2000, and its applicable and periodically amended rules ("IT Act"), are created by a computer system and do not necessitate physical or digital signatures. You affirm that you are at least 18 (eighteen) years old and have not been previously suspended, removed, or disqualified by the Company from accessing the Services or using the Platform for any other reason. Furthermore, you assert and guarantee that you possess the right, authority, and capacity to accept and adhere to the Terms. Impersonation or misrepresentation of your identity, age, or affiliation with any person or entity is strictly prohibited. 3. Sign-Up and Consent Requirements
3.a. To access our Services, you may be required to furnish essential details, including but not limited to your name, mother's name, father's name, date of birth, gender, Permanent Account Number (“PAN”), signature, marital status, nominee details, cancelled cheque, photograph and video recording, email ID, phone number, educational or professional qualifications, business name, business address, nature of business, Goods and Service Tax Identification Number (“GSTN”), Tax Deduction and Collection Account Number (“TAN”), bank account details, Unified Payment Interface (“UPI”) ID, and/or other pertinent payment-related details, as applicable.
3.b. Your agreement to provide the information mentioned above, or any other details essential for us to deliver the Services, is implied at the time of sign-up or subsequently. You acknowledge that providing your Aadhaar ID is voluntary unless mandated by applicable law, and you have the option to provide an alternative KYC proof.
3.c. By providing information, you affirm that it is true, accurate, current, and complete, and you agree not to misrepresent your identity or account information. You are responsible for maintaining accurate and up-to-date account information.
3.d. If you upload information regarding third parties, ensure that you have their express written consent for using their information on the Platform. Obtain written consent for receiving communications from the Company on their behalf, including information about us and the Services, promotional offers, and other Service-related matters. You assume responsibility for obtaining and confirming such consent, and we assume consent is granted if you provide information about third parties during your use of the Platform.
3.e. Providing false, inaccurate, or outdated information may result in the suspension or termination of your account and the prohibition of current or future use of the Platform. You are responsible for maintaining account confidentiality and for all activities occurring under your account.
3.f. Promptly notify us in writing at support@dsquarepro.in of any unauthorized use or disclosure of your profile or any security breaches concerning your profile.
4. Conditions of Platform Use
4.a. Your commitment to utilizing the Platform solely for lawful purposes is imperative. You are accountable for all activities stemming from your use of the Platform or availing the Services. Any liability arising from Platform use is expressly excluded.
4.b. Acknowledge that our payment facility is not a banking or financial service but a facilitator, offering an electronic payment option for transactions on the Platform. We do not act as trustees or in a fiduciary capacity concerning these transactions.
4.c. Service Level Terms: While we strive to provide the Platform with reasonable technical support, we cannot guarantee continuous availability. Unforeseen events such as outages, maintenance, or third-party issues may impact access. We do not commit to 24/7 availability and reserve the right to cease support for old versions at our discretion.
4.d. Updates: Periodic updates may be provided without additional charge, becoming part of the Platform and subject to these Terms. The Company holds no obligation to provide such updates and may cease support for old versions at any time.
4.e. User Conduct: By accessing the Platform or availing Services, you agree not to:

5.b. Any information, including compliance deadlines, tax-related news, and regulatory updates, is for general guidance only. Due to the dynamic nature of laws and regulations, there may be delays or inaccuracies in the information provided. This Platform does not engage in providing legal, accounting, tax, or professional advice. It is not a substitute for consultation with professional advisors, and any use of the Platform or Services is at your own risk.

6. Intellectual Property and Data Usage

Data Usage: By entering or uploading data onto the Platform, you grant us, our Strategic Partners, third-party service providers, and affiliates the rights to host, use, copy, transmit, process, store, share, analyze, display, make derivations, and back up all submitted data. This includes personal and financial information, and is done to enable Platform use, improve services, create new offerings, communicate with you, and provide information we believe maybe of interest. You affirm that you have the necessary rights to grant these permissions.
6.e. Data Loss: Recognizing the inherent risk of data loss in technology usage, you are responsible for maintaining copies of your entered data.
6.f. No Compensation: In the event of downtime, access issues, or data loss, discontinuing Platform or Service use is the sole recourse, without any entitlement to compensation.
7. Know Your Customer/Client Requirements (KYC)
7.a. Consent and Information Sharing:
By using the Platform, you expressly consent to providing necessary information, including KYC Documents, to verify your eligibility. This information may be shared with entities such as Right Horizons, online payment gateways, and our affiliates. KYC Documents encompass details like mobile number, PAN, signature, and more. You commit to supplying accurate and current KYC Documents, and any false information is considered a material breach of these Terms.
7.b. Use of Personal Data:
We may process your personal data to deliver Services. This involves the potential processing, transfer, or disclosure of your personal information to third parties like AMCs, RTAs, KYC Registration Agency (KRA), payment gateways, statutory bodies, agencies, or third-party service providers and Strategic Partners.
8. Effective Communication Policies
8.a. Consent for Communications:
By using the Platform, you agree to receive communications from the Company, covering information related to Platform or Service use, updates about the Company and its Services, promotional offers, and other matters related to the Services. If you access the Platform on behalf of a third party, with their prior consent, we may send these communications to your customers or other third parties whose information you've made available on the Platform.
8.b. Alerts and Notifications:
We may send alerts via email, SMS, WhatsApp messages, push notifications, or other means to the mobile numbers provided by you. If your number is on the Do Not Disturb (DND) list, you are responsible for de-registering from the list and acknowledge that we are not liable for non-receipt of SMS.
8.c. Authentication and Liability:
We are not obligated to confirm the authenticity of the recipient of the alert. The Company cannot be held liable for the non-availability of the SMS/email alert/push notification service.
8.d. Service Facility Disclaimer:
The SMS/email alert/push notification service is provided for convenience and may be prone to errors. The Company is not liable for any loss, damages, claims, or expenses incurred due to the facility.
8.e. Network and Connectivity:
The quality of the SMS/email alert/push notification service depends on factors such as network infrastructure and connectivity. The Company is not responsible for non-delivery, delayed delivery, or distortion of alerts.
8.f. Internet Security Responsibility:
The Company does not guarantee that files available for download through the Platform will be free of viruses or damaging code. You are responsible for implementing internet security procedures and ensuring the accuracy of data input and output.
9. Third-Party Products and Services
9.a. Additional Terms and Conditions:
Our Platform incorporates products and services from third-party service providers, each with its own set of terms that apply to you. By using these third-party services, you agree to abide by their additional terms, including terms and conditions and privacy policies governing data usage. The descriptions and associated links for third-party products and services are provided by the respective providers, and they are solely responsible for the representations made therein. We do not endorse or assume responsibility for third-party products or services.
9.b. No Warranty or Liability:
We make no representations and explicitly disclaim all warranties and liabilities related to third-party services, encompassing their accuracy or completeness. Additionally, all intellectual property rights pertaining to third-party services remain the exclusive property of their respective providers.
10. Fees: The Company reserves the right to charge fee for the Services and non-payment may result in denial of Services.
11. Payment: All the payments for services are accepted only in the name of Dsquare Professional Services Private Limited and the type of account is solely "Current Account" through NEFT/IMPS, RTGS, and digital payment wallets (Razor pay, PayU, ICICI EazyPay).
Referring to the above clause. We do not accept payments on personal accounts or under any other name. Dsquare is a registered trademark and will not be responsible for anyone claiming to provide services under our brand name, and accepting payments under any other name. Any concerns related to authentication of payments to the Dsquare can be confirmed by contacting support@dsquarepro.in.
